
“I would have had money, I would have paid…” assures Karim El Assioui, 48 years old. On December 10 shortly before 5 p.m., at theNoyon intermarkethe tried to steal chocolate bars, cheese, vodka, beers. The amount of food and drinks he had to take out of the store was €33. The store’s security service, who had spotted him thanks to the cameras, picked him up after he crossed the checkout line.
As he did not pay for this shopliftingthe security guards called the municipal police. They say they saw him say vodka inside the store. Which he denies. He admits everything else except being aggressive towards the security guards. “He grabbed me aggressively,” he explains. And He told me “You empty your pockets in front of everyone”. But I’m ashamed of stealing. Noyon is my town. I asked that we go into the office. I regret…”
He also denies having fled the day before with a bottle of alcohol. On the other hand, he reminded the court that he left personal effects at the store: two caps, a vest, €5, etc.
“But listen to the court!”
In addition to this shoplifting, the defendant appears for not having reported to the police station, to prove his address. That’s what he’s supposed to do once a year, as a perpetrator of sexual exhibitionism. His record of 46 mentions includes nine acts of sexual exhibition.
“Justice has seen you often,” notes the president. “I went bad in military service… When you have money, you have friends. When you don’t have money, you don’t have friends. It’s like in prison…” The accused goes from rooster to donkey constantly. He has difficulty concentrating on what the court is saying about him. “But listen!”, his lawyer, Mouna Taoufik, will lecture him several times.
A former polydox addict, he is undergoing heavy treatment. He experiences difficulty concentrating, linked to anxiety and psychological fragility. “Yes, I need care,” he agrees. I’m on the detention waiting list.” Since December 10, the defendant has returned to prison. “I need to be alone in the cell,” he said, anxious at the thought of an attack. Having no visitors, he attended school there. “It helps me…”
Nine sexual exhibitions
“This is far from the first time that he has been tried for theft,” recalls the prosecutor. He knew he didn’t have the right to shutter. The excuse of dietary needs does not hold up, even though he stole alcohol.” Concerning the non-compliance with his obligation to prove his address, the prosecutor is concerned. “There are nine sexual exhibitions, sanctioned by different courts. It is therefore imperative that he scrupulously respects the rules concerning him.
The prosecutor says he is “very hard pressed to propose a constructive sentence, given all the reprieves revoked. “He is incapable of respecting a probationary suspension measure.” It therefore requires eight months in prison, with continued detention.
“We want to condemn him for sexual acts that he has not yet committed”
“The facts are recognized,” notes Master Mouna Taoufik. What punishment should he inflict? The prosecutor explains that “€33 is not the problem”, but that the problem “is sexual dangerousness”. I see that my client is being tried for theft and that they want to repress acts of a sexual nature that he has not yet committed.”
She pleads for a probationary stay with care for the defendant, whose last conviction for theft dates back to 2004. “I have never seen so many sexual exhibitions in a locker, it’s true (the last time in 2022). But he’s not here for that. I don’t see how not to remember the alteration of discernment. Eight months firm! What is the use of this sentence in the context of a theft of €33? Especially since there is nothing coherent given the stolen items. We didn’t even offer him a refund.”
He was sentenced to four months, with continued detention.
