“Italy is a great democratic country and I must reiterate that it knows how to look after itselfin compliance with its Constitution” states the President of the Republic Sergio Mattarella referring to the words of Elon Musk (“These Judges Must Go”). The head of state also calls for respect for the “sovereignty” of other countries.
The clarification of the President of the Republic follows the comment of the patron of X regarding the Albania case: Musk wrote this regarding the news, posted by a user on the social network, regarding the decision of the Court of Rome to suspend the validation of the detention of migrants in Albania.
Maddalena (National Association of Magistrates)
“We are disconcerted by this intervention by a very powerful foreign tycoon. Here the independence of the judiciary is no longer at stake, but here it is a question of sovereignty of the Italian state. First of all, we should think about this type of defense and then about jurisdiction” replied the vice president ofNational Association of Magistrates, Alessandra Maddalena.
“An American magnate who is so influential in the new administration of that country who talks about internal affairs of the sovereign Italian state, this is the fact that stands out. He interferes in Italy’s affairs by making unmotivated judgments, ungenerous at best, without anyone thinking of the government responding, saying that these are Italy’s affairs on which he has no right to intervene. Borders are defended a lot precisely in terms of illegal immigration and the supreme duty to defend borders is recalled, these are borders too. There are ideal borders that cannot be violated by those who think they can interfere in the internal affairs of a sovereign country” the president of the ANM adds to the matter today, Giuseppe Santalucia.
Carbone (Csm): dangerous words for democracy
“Elon Musk’s words against Italian judges are dangerous words. These new oligarchs who exploit new worlds (such as space, the ether, social media and new technologies) to control world politics are a danger for democracy. After an incursion into German politics, today the jurist Elon Musk enters violently by criticizing state power. All this is unacceptable but above all dangerous” declared the lay councilor of the CSM, Ernesto Carbone.
The political reactions to Musk’s post on
“Italy and Europe do not take democracy lessons from anyone, much less from Elon Musk, whose sole aim is to undermine our fundamental values, the rule of law, the most basic principles of our democracies, starting from independence of the judiciary. All things evidently unknown to Musk in building his regimes in space”, he replied on social media Sandro Gozi, MEP for Renew Europe and Secretary General of the European Democratic Party.
“Musk’s attack on the Italian judges is not only unacceptable and an interference from Trump’s right-hand man, but it is the unmistakable signal of what Musk wants to achieve, that is, to build a technological autocracy thanks to his economic empire to do without of democracy. With its social platforms, the conquest of space with its satellites through which it can influence military conflicts and geopolitics, as in Ukraine, poses a problem for democracy Of Elon Musk defending our Constitution and judiciary.” Thus in a note the spokesperson for Europa Verde e deputy of the Greens and Left Alliance, Angelo Bonelli.
“Elon Musk’s words are inappropriate because, even from abroad, they fuel a clash with the judiciary that the Center-Right does not want. There is not a conflict between state powers, between the government and the judiciary as a whole, we simply believe that some courts have made wrong and instrumental decisions. It is important for us, in the interest of the country, to affirm a fundamental principle of democracy: it is Parliament that makes the laws and the judges have the task of enforcing them, in their autonomy, avoiding creative interpretations. The Ministry of the Interior did well to appear before the European Court to reiterate absolute respect for the principles established by the EU”. He states it the president of Noi Moderati Maurizio Lupi.
“Elon Musk is right. On December 20th I could receive a 6-year prison sentence for having blocked, as Interior Minister, the landings of illegal immigrants. Seen from abroad, all this seems even more incredible.” He states it on social media the deputy prime minister and leader of the League Matteo Salvinicommenting on Musk’s words (“These judges must go”), regarding the suspension of the validation of detention for seven migrants decided by the immigration section of the Court of Rome which also referred to the EU Court.

Judges: the safe countries are established by the EU
”It must be highlighted that the criteria for designating a State as Safe country of origin are established by European Union law. Therefore, without prejudice to the prerogatives of the national legislator, the judge has the duty to always and concretely verify, as in any other sector of the legal system, the correct application of Union law, which, notoriously, prevails over national law where incompatible with it, as also provided for by the Italian Constitution”. This is what he writes Luciana Sangiovannipresident of the Section for Personal Rights and Immigration of the Civil Court of Rome, in a note after the suspension decided by the judges of the detention of the seven migrants.
The suspension of proceedings, however, “does not stop the legal deadline from running forty-eight hours of effectiveness of the detentions ordered by the Police Headquarters”, therefore the migrants will return to Italy. An eighth migrant, also an asylum seeker and found to be vulnerable, had already been ordered to return to Italy.
Last October 18, the judges of the specialized immigration section of the Rome court had not validated the detentions issued by the Rome police station for the first migrants who had been brought to the detention center for the repatriation of Gjader. Order which was then challenged by the Interior Ministry in Cassation.
La Russa: the European Court will decide on the Albania case
“I believe that it is a very controversial topic today and I believe that in the end a decisive word must arrive, there has been an appeal to the European Court and that may be the right place to define what in my opinion is a problem that would have been better if it hadn’t arisen, but since it has arisen we have to define it in some way.” He explained it the president of the Senate Ignazio La Russaon the sidelines of an event at the Palace of Justice in Milan, responding to a question from reporters on the judges’ new stop on the detention of migrants in Albania.
Tajani: some magistrates want to impose the government’s line
“In a democracy there is a tripartite division of powers. When one of these powers oversteps its borders it puts democracy in difficulty. There are some magistrates who are trying to impose their political line on the government. This is not acceptable. I respect all the decisions of the judiciary, I do not engage in controversy and I do not offend anyone, I only say that it is a choice that goes against the tripartite division of powers. It is not a magistrate who decides which country is safe because he doesn’t know. Because he doesn’t deal with these things. If the government that has the tools to do so says that a country is safe, then something is not working.” As the Vice President of the Council and Minister of Foreign Affairs, Antonio Tajani commenting on the suspension decision.
Salvini: another political ruling, not against the government but against Italians
“Another political sentence not against the government, but against Italians and their security. Government and Parliament have the right to react to protect citizens, and they will do so. Provided that some other magistrate, in the meantime, does not condemn me to six years in prison for defending the borders…”. He writes it on X the deputy prime minister and minister of transport, Matteo Salvini.
The Interior Ministry will appear before the EU Court of Justice
Meanwhile, according to what we understand, the Interior Ministry will appear before the European Court of Justice to argue its case after the decisions of the judges of the Court of Rome to suspend the validation of the detention of the 7 migrants.
