After the decision of the Court of Rome, the Visalli ship arrived in the port of Brindisi carrying the seven migrants, of Bangladeshi and Egyptian origin, who had been in the center of Gjdaer, Albania since last Friday. La Russa: Let the European Court decide on the Albania case
“I believe that it is a very controversial topic today and I believe that in the end a decisive word must arrive, there has been an appeal to the European Court and that may be the right place to define what in my opinion is a problem that would have been better if it hadn’t arisen, but since it has arisen we have to define it in some way.” The president of the Senate Ignazio La Russa explained this on the sidelines of an event at the Palace of Justice in Milan, responding to a question from reporters on the judges’ new stop on the detention of migrants in Albania.

Judges: The EU establishes safe countries
”It must be highlighted that the criteria for designating a State as Safe country of origin are established by European Union law. Therefore, without prejudice to the prerogatives of the national legislator, the judge has the duty to always and concretely verify, as in any other sector of the legal system, the correct application of Union law, which, notoriously, prevails over national law where incompatible with it, as also provided for by the Italian Constitution”. This is what he writes Luciana Sangiovannipresident of the Section for Personal Rights and Immigration of the Civil Court of Rome, in a note after the suspension decided by the judges of the detention of the seven migrants.
The suspension of proceedings, however, “does not stop the legal deadline from running forty-eight hours of effectiveness of the detentions ordered by the Police Headquarters”, therefore the migrants will return to Italy. An eighth migrant, also an asylum seeker and found to be vulnerable, had already been ordered to return to Italy.
Last October 18, the judges of the specialized immigration section of the Rome court had not validated the detentions issued by the Rome police station for the first migrants who had been brought to the detention center for the repatriation of Gjader. Order which was then challenged by the Interior Ministry in Cassation.
Tajani: some magistrates want to impose the government’s line
“In a democracy there is a tripartite division of powers. When one of these powers oversteps its borders it puts democracy in difficulty. There are some magistrates who are trying to impose their political line on the government. This is not acceptable. I respect all the decisions of the judiciary, I do not engage in controversy and I do not offend anyone, I only say that it is a choice that goes against the tripartite division of powers. According to what we understand, the Interior Ministry will appear before the European Court of Justice to support its reasons after the decisions of the judges of the Court of Rome to suspend the validation of the detention of the 7 migrants.
