Friday December 6, in the evening, the Rest’o bar of Noailles (Oise)) was privatized by the fire brigade. Unfortunately, the evening turned out rather badly. Around 9 p.m., the police were called for violence which allegedly took place between the couple who had managed the bar since September.
Upon their arrival, the gendarmerie soldiers noticed that Ludovick Korenika, 42 years oldhas a bright look and almost falls when passing behind the counter. It is his partner who tells them the facts. First, his companion sent him a warning message saying: “I don’t want anyone behind the bar. If you care about them…“. But while she is busy in the kitchen, he grabs the knife she is holding and shouts: “come on, I’m going to crash you“. She then went out to smoke a cigarette. She then hears noises coming from inside. Her companion threatened her daughter by telling her: “come, I’m going to kill you… Come, I’m going to kill you“.
The man denies the acts of violence
Before the Beauvais court this Monday, December 9, during his immediate appearance, Ludovick Korenika completely contests these acts of violence and threats. However, he admits to having refused to take the breathalyzer test.because it’s not just him who should have done it“. He does have an explanation: around 9:15 p.m., he refused to serve drunk people. His partner’s daughter accused him of taking advantage of her mother’s money, called him a “poor piece of shit” and doused him with the contents of a bottle of champagne. That’s what made him react. He denies the episode with the knife in the kitchen for the simple reason that he did not set foot there.
Since nothing happened, according to him, the deputy prosecutor asks him: “why does the girlfriend’s friend call the police? Why do two people testify that these facts took place? Lie or conspiracy?» The substitute comes to other violence against this same companion, which she came to denounce after the events, and a conviction pronounced on November 15. She accuses him of having assaulted her with several blows and of having strangled her. She would have called the defendant’s son, aged 11, to help her. “The child was heard and he confirms», Indicates the substitute. But for him, the childhas no concept of time“. “Everyone lies except you», concludes the magistrate.
Already convicted four times for violence against a spouse
Ludovick Korenika has already been convicted six times since 2003 and this is his fourth appearance in court for spousal violence, with three different victims. “It doesn’t happen to everyone», Comments the president.
The substitute recalls that last November, Ludovick Korenika received a suspended prison sentence for violence without incapacity against his partner. While the representative of the prosecution had requested incarceration, the court gave the relationship a chance, because during the four months following the events nothing happened. “This relationship is doomed to failure, it risks leading to more serious events», notes the substitute. He then discusses the fate of the defendant’s children in his care after the death of their mother. “They will be alone if their father goes to prison. I’m not here to add one drama to another.» He asks for a prison sentence to make him understand, hoping that the pre-trial detention has made him think: twelve months in prison, but without continued detention and a ban on meeting the victim and her daughter.
He receives a firm sentence
Domitille Risbourg, whose client disputes everything except the refusal to submit to the breathalyzer, points out that “not everyone was heard, which would have made it possible to see things more clearly“. She regrets that the checks were not carried out without bias. “Everything is based on the victim’s statements which were taken at face value.» She pleads for the release of her client.
Ludovick Korenika was acquitted of the acts of violence committed at his home in Bailleul-sur-Thérain. He was found guilty of the events of December 6. He gets ten months in prison which the sentence enforcement judge may subsequently adjust. He is prohibited from meeting his partner and appearing at her home, who resides in the house that belongs to him, for three years. He will not have to meet his partner’s daughter for three years. He will either have to wait for the victim to leave on their own or have them expelled through the courts. They will no longer be able to operate the Noailles bar together.
