This Friday, January 20, a case judged for immediate appearance at the Beauvais judicial court arises from a report from National Education. Which led the gendarmes to question Kevin Demaille, 31, whose children complained about his behavior. The girl said she was slapped on the back of the head and doesn’t want to go to his house anymore. The son says he found himself with a gun to his head, that at his father’s house they watch horror films and that he is sometimes unable to cook them food because he has drunk so much.
The father denies that he was unable to feed them because he was drunk and explains that he put the gun to his son’s head because the child had pointed it at him before: “I did like him“. He also says that he had the child shot, that he was frightened when he heard the detonation: “that way, he won’t do it anymore. I missed my life… He must experience violence“. He estimates the child’s trauma at three, on a scale of zero to 60, while the president estimates it at six or seven: “You don’t raise children like that» !
The prosecution demands 15 months in prison
The father was examined by a psychiatrist who found no pathology. He only drinks alcohol on weekends.
The children are represented by José Castellote. “It is not because the father has experienced violence that he must demonstrate it to his son by pointing a gun at him, we can mime without taking action“, he said. The lawyer is struck by the trivialization of what he is accused of: “he doesn’t beat them that much, in short, it’s nothing to beat a cat. He is the victim of his marital situation… Everything is not permitted, there is a measure to respect», he demands.
For the deputy prosecutor, the accused minimizes the scope of his actions as well as the repercussions on the children. He is asking for a sentence of 15 months in prison, nine of which will be suspended on probation with modification of the fixed part of the sentence.
He will have to compensate his children
The defense lawyer; Maxence Sarlin pleads for the release of his client because “nothing proves that the facts actually occurred during the prevention period which goes from October 2022 to June 2024, especially for the girl who places the slap she received during a vacation in Morocco which took place well before“.
Kevin Demaille was found guilty, he was acquitted for the violence against his daughter and received a one-year prison sentence under probation with an obligation to work for alcohol and psychological care and a ban on meeting his children for two years, a ban which could be lifted on the advice of the family affairs judge. He will have to compensate his children for their moral damage: 500 euros for his daughter and 1,000 euros for his son.
