A market value of around €100,000. Huseyin Kumru, almost 31 years old, appears for possession and use of cannabis, cocaine, heroin, crack and MDMA. And alsoweapons miscellaneous: two guns (Mauser and Browning) with their ammunition, and a Ak47. A real “weapon of war”, comments the president. Investigators got their hands on these drugs and weapons at 3 square Berlioz, famous point of deal from the district of Clos-des-Roses in Compiègne. The alleged facts extend over several months, from 2023 to 2024.
“My son, I love you,” says a lady in a wheelchair to the defendant, before disappearing from the courtroom, this Thursday, December 19. “It must be your mother who came to support you,” continues the president. It’s good. Often, the defendants are alone.”
Born January 25, 1994, Huseyin Kumru, single without children, lives with his mother. He appears as a repeat offender for these facts, after a judgment of November 17, 2022 before the Compiègne court. Imprisoned for another reason, he requests time to prepare his defense. He remains presumed innocent of the facts.
The file concerning him is “particularly voluminous”. “Mr has been in detention since the day before,” explains the president, a teacher, addressing the third year trainees who came to attend the hearing. He was convicted multiple times for identical acts. There is a proven risk of renewal of the offense, due to the lucrative aspect of the activity.”
“I intended to surrender, but not right away”
“I worked in construction, catering… I have always worked…” explains the defendant. The courts were looking for him to carry out a sentence following missed appointments as part of his suspended sentence. “I wanted to submit but not right away,” says the defendant. You don’t have to believe me…” “And just before Christmas, you get arrested,” notes the president. If you had respected the obligations, you might have spent the holidays with your family.” “I don’t know what to say…” replies the defendant, who is serving a twenty-four month sentence. He is available for release in January 2027.
Usually consuming five to six joints a day, he says he doesn’t feel the withdrawal. “I asked for care,” he explains. I had several periods of stopping and starting again. I only smoked in the evening, once I knew I wasn’t going to move.”
Huseyin Kumru has nine mentions in his criminal record between 2012 and 2022. In May 2024, the courts decided not to modify a six-month suspended sentence.
He had benefited from a measure of leniency from the prosecution, “which agreed to arrange it in the form of a bracelet”, recalls the president. “It’s very unfortunate for me,” comments the defendant
His record includes offenses related to drugs, such as driving a vehicle after use, trafficking, but also aggravated violence in 2021.
“Every day of detention must be useful”
The prosecutor requests continued detention due to his absences before the SPIP and before the sentence enforcement judge, and revocations of probationary suspension. “It took an arrest warrant,” she said. He ran away. The only accommodation solution is with his mother, accommodation which is a deal point. Continued detention is necessary to guarantee representation before the courts and prevent the recurrence of the offense.”
Maître Mouna Taoufik recalls that the guarantee of representation is assured since he is incarcerated in Amiens, “which is not a sieve”. “Security and detention measures must have meaning, whether provisional or in execution of a sentence. The president told him “you are going to be convicted, so you might as well open the meter”. The problem is that this measure of pre-trial detention will prevent him from having access to care, work and training. However, each day of detention must be useful.”
Between now and the hearing on January 23 at 1:30 p.m., the date of referral, the accused will be in pre-trial detention. He is presumed innocent of the charges against him.
