No one knows if the defendant is truly a fan of petanque. Still, on the evening of November 24, he wandered down a street in Chambly and sees two triplets balls in a vehicle. Neither one, nor two, Mohamed Amine Louassaa appropriates the promise of summer parties in the beneficial shade of the olive trees and disappears without asking for his rest. Bad luck, there are days like this, the friend of the owner of the car, an Audi 4×4, and the game of bowls, sees the indelicate person from his window committing his theft. He immediately rushes into the street to recover the ill-gotten property, but not for long, since he spots the author of the theft near the “Le bon coin” café. What follows is a distribution of well-felt slaps which will cause some bloody wounds on the defendant’s face.
A seemingly banal affair
It’s midnight. Called, the gendarmes intervene quickly and try to shed light on this apparently trivial matter. It quickly becomes apparent that the individual is indeed the perpetrator of the theft. The balls were in fact found during a quick search of his presumed home nearby. During this investigation, the soldiers noted the presence of two individuals in the apartment. Mohamed Amine Louassaa addresses them in Arabic, asking them to say that they found the balls on the stairs. No luck yet, one of the gendarmes is Arab-speaking. He understands the exchange, as he also understands Louassaa’s words: “I’m going to slit the throat of the other dirty black guy”, speaking of the friend of the owner of the balls.
Then the situation quickly gets out of hand. The pétanque lover stubbornly refuses to let himself be handcuffed. The police have all the trouble in the world getting him into their vehicle to take him to the station. He spits on them, tries to bite them and hits his head on the car window which ends up breaking. Sent to the hospital, the circus continues, its sputum Full of blood dot the corridors. He kneels during the X-ray which he refuses to play at first and hits his head on the ground.
He denies the insults
Questioned by the president, he half-heartedly acknowledges the rebellion but denies everything else outright, including the insults uttered at the military described as a “Son of a bitch”, appalling at their banality.
At the hearing, he ends up saying “I apologize but it’s not me”, which leaves a president speechless as he tries to decipher the statement. “If it’s not you, why apologize?” Silence of the accused. The president then tries to find out a little more about the man who is of Algerian nationality. The man entered illegally through Italy in 2018 and is in an irregular situation. During his short pre-trial detention, he was served with an OQTF (Order to leave French territory). He says he works on a permanent contract in a construction company based in Méru.
Sputum full of blood
After verification, the said company would have emigrated elsewhere, near Portugal. As for his address, nothing is clear either. Between Chambly, Beauvais and another where he lives with a friend, the president, a bit tired, tries to sort things out which he quickly gives up.
In her indictment, the deputy prosecutor denounces a combination of theft, rebellion and violence, in particular by the bloody spitting in the faces of the soldiers who are now forcing them to take HIV detection tests.
The only positive point to be put to the defendant’s credit lies in a clean criminal record, rare within these walls and in a context of immediate appearance. It is probably this absence of liabilities which leads the public prosecutor to request simple suspension for a period of twelve months. As an additional penalty, a ban on contact with his victims is requested with a ban on appearing in the Oise for a period of five years.
His lawyer requests leniency from the court
Maître Émilie Rebourcet discusses during her client’s defense a case in which gaps appear and points out certain inconsistencies in the testimonies, particularly regarding her client’s clothing. She also takes up the testimony of one of the gendarmes who declares on the stand, during the breaking of the window, “having never seen that” to underline “irrational behavior” and requests the leniency of the court which at the end of this judgment, which will have lasted all afternoon, fully following the requisitions of the public prosecutor.
The two gendarmes, civil parties in this case, are awarded 500 euros each. The damage to the screen-printed vehicle will be the subject of a civil interests hearing on March 12, 2025.
