The affair is creating a buzz. Rillette, this domesticated sow will not be euthanized and will be able to stay with Elodie Cappé, this woman who took her in near Chaource (Aube). This is the decision that the courts have just made this Monday, January 13. However, the keeping of wild animals in captivity is governed by the environmental code. Here is a quick reminder of the legislation in force.
On the government portalthere is a reminder of the regulations regarding the keeping of wild animals in captivity.
L’decree of October 8, 2018 setting the general rules for keeping animals of non-domestic species specifies the principles applicable to the keeping of animals of non-domestic species. Any person, natural or legal, who holds one or more specimens in captivity must in particular:
- have accommodation, facilities and equipment designed to guarantee the well-being of the animals housed and satisfy their physiological and behavioral needs;
- have the skills required and adapted to the species and number of animals so that they are maintained in good health and maintenance;
- prevent risks relating to the safety of the specimens concerned as well as the safety and peace of third parties;
- prevent the introduction of animals into the natural environment and the transmission of human or animal pathologies;
- ensure the individual and permanent marking of certain animals, at the latest – unless exempted – within the month following birth.
This decree also governs the obligation to identify animals of non-domestic species.
A similar case in Oise in Ribécourt
12 years ago, a case similar to this broke out in Oise in Ribécourt-Dreslincourt. During August 2013, Daniel Guéguen received a letter from the ONCFS (National Office for Hunting and Wildlife) informing him of the opening of an investigation into the illegal possession of a non-domestic animal.
At the time, it had been 9 years since he adopted a sow, who lived with him on a large enclosed plot of land.
Immediately, Daniel Guéguen moved heaven and earth to guard his sow, whom he named Sophie. He launched a petition which will gather around 500 signatures. At the time, local elected officials came forward in support of Daniel.
He was finally able to keep his sow.
The name of Daniel Guéguen returned to the news in 2019. He was the subject of a murder attempt, from which he never recovered. A few weeks after this very violent attack, he fell to his death from the window of his hospital room in Noyon.
In 2022, the author of this attempted murder was sentenced to 14 years in prison.
